The Borough of Oradell NJ REQUIRES all homeowners to fix their sidewalks! See below.
Chapter 235 Section 19 (ecode360.com)
“A.
In case any sidewalk becomes out of repair, the owner or occupant of the lands abutting such sidewalk shall forthwith, upon receipt of written notice from the Superintendent of Public Works, repair or cause the same to be repaired and made in good and passable condition and conform to the requirements of § 235-19.
B.
With respect to those properties located adjacent to those streets and sidewalks improved as a part of Ordinance 1088 adopted by the Borough of Oradell on December 1, 1998, and entitled “Improvement of the Intersection of Kinderkamack Road and New Milford Avenue,” any and all repairs to sidewalks shall be made in conformity with the special sidewalk/pavement specifications and standards prepared by Burgis Associates, the provisions of which are incorporated herein by reference and copies of which are available through the office of the Borough Clerk.”
Sidewalk repair in addition to maintenance in the State of New Jersey is the duty of the abutting house proprietor. Thousands of property owners are not aware of this ordinance and they assume that their city or state is responsible for repairing broken sidewalks. In many cases, the house owner will hire contractors to make the repair or their municipality will contract the work but will assign the property owner for 100% of the repair cost. In 2012, the borough of Highland Park in New Jersey initiated a program that demanded estate proprietors to fix defective sidewalks adjacent to their homes. Your city or borough can be next!
A lawsuit waiting to happen…
Estate proprietors in Oradell are accountable for preserving the sidewalks in front of their buildings. When they fail to effectively repair their sidewalks, they become accountable for the injuries that pedestrians experience. These pedestrians that hurt themselves because of your beat-up sidewalk have the legal right to sue you since you are the home proprietor. There are also dozens of lawyers that love to follow through with these types of premise liability cases, which will cost you a lot of money in the long run. A lot of property owners in the State of New Jersey have been taken to court due to their neglect or the lack of knowledge in regards to sidewalks and responsibility.
Your city or borough can also send you a notice demanding that you re-construct your sidewalk. Failure to comply within a specific time frame will result in fines. Spare yourself a lawsuit and fines by contacting a sidewalk repair company ASAP!
Types of Sidewalk Defects
There are many types of defective sidewalks that can prove dangerous for Oradell pedestrians.
- Tree roots: When sidewalks go too long without repair, tree roots may cause them to become uneven.
- Collapsed sidewalks: Severely damaged sidewalks may have large parts caved in or separated from the rest of the walkway. This type of a situation certainly poses a serious fall hazard.
- Trip hazards: It is easy to trip and fall on large cracks that cut across poorly maintained sidewalks.
- Improper slope: Uneven sidewalks may have large portions that do not line up with the rest of the walkway.
- Patchwork: In an effort to save money on repairs, it is common to see inadequate patchwork jobs on specific locations that make the sidewalk surface uneven.
- Missing cobblestones and bricks: It is necessary to properly maintain walkways that are not made from concrete to ensure the safety of pedestrians.
